Thanks to Law n. 279/2000 these emigrants and their descendants have finally been equated with the Italian citizens, thus healing a long-suffering discrimination that has been taking over for years. The descendants of the emigrants originating in the territories belonging to the Austro-Hungarian Empire, since December 2000 can obtain the citizenship by submitting a declaration of election within the 20.12.2010 (term extended by art. 28 bis of Decree-Law 273/2005), with the competent Italian authority at the place where the person resides. If the person resident in Italy is competent the registrar of the Municipality of residence, if abroad, the diplomatic or consular authority of the place of residence.
Art. 23 Law 91/92 reads as follows: “article 23 1. The declarations for the purchase, retention, repurchase and waiver of citizenship and the provision of the oath provided for in this Act shall be made to the Registrar of the municipality where the declarant resides or intends to establish the own residence, or, in the case of residence abroad, before the diplomatic or consular authority of the place of residence. 2. The declarations referred to in paragraph 1 and the acts or measures relating to the loss, preservation and repurchase of Italian citizenship shall be transcribed into the registers of citizenship and shall be recorded on the fringe of the Act of Birth.”
